  • Descrição: For purposes of registration, the Dominican Republic classification of goods and services is different from the international classification. Law No. 1450, Article 22, establishes that the products and merchandise which may be protected by registered trademarks fall within 70 classes. The international classification only includes 42 independent classes. Therefore, before requesting registration, the appropriate class of the product needs to be identified in the national trademark classification. A trademark or name can be transferred together with the goodwill of the product or business or together with the commercial or industrial establishment for which it is registered. The law does not prohibit 3rd parties from bringing proceedings for cancellation and opposition to the mark or name transferred. Renewals are possible for 5, 10, 15, and 20-year periods upon expiration of the time for which any registration was made. Fees have been established for application, searches, and publications. Assignments, licenses, changes of names, addresses, and renewals are also subject to payment of fees.
