  • Descrição: Feldthusen believes that, in tort, Canada's law of punitive damages is not in urgent need of reform. He sees as the most pressing need changes in procedure, such as class action law, to make punitive damages viable in cases of systematic wrongdoing. In contract, he predicts a legislative response to the decision in the case of Vorvis versus Insurance Corp. of British Columbia, or alternately, that the courts will expand tort duties to circumvent that decision. Feldthusen and Vidmar undertook an empirical study of exemplary damage claims and awards in Ontario that indicated that such awards remain an extremely unusual remedy. Chapman develops a compensatory theory of aggravated damages to show that the availability of what appear to be punitive damages in certain contractual contexts can be better explained and understood. Cherniak believes that punitive damages are an entirely appropriate and necessary part of damage law in Canada.
